The ERC Manager acts as the key link between the ERC Function Head and the operation of the Business Unit. The role is broad and diverse requiring a Curious mind. The primary function is to support the ERC Function Head in the effective implementation of company ERC policies to ensure the Business Unit complies with the local country legislative frame-work (external) and with all relevant internal policies and procedures and reduces or mitigates business risk where relevant.

The ERC Manager is required to support the ERC business relationship in an unbossed and inspiring manner by engaging as a Business Partner with the Business Unit, providing sound and consistent guidance in respect of ERC Policies.

Major Accountabilities

Ensure the Business Unit complies with the both external and internal regulations and policies:
– Act 101 of 1965
– P3 Policy and Guidelines
– Code of Ethics
– Conflict of Interest
– Company Level Controls as it effects ERC
– Anti-Bribery Third Party Due Diligence Policy
– Speak-Up Process

Ensure that all SA Standard Operating Procedures are always valid with content that is relevant and up to date.

Develop an annual Risk Monitoring Plan, execute and report deviations from agreed standards. Support the Business Unit in remediating deviations and observations from Standard Operating Procedures.

Develop an annual ERC Training Plan, execute and report.

When required, support ERC Head to effectively remediate Internal Audit reports or In-Country Risk Monitoring visits.

Perform regular risk monitoring of all activities within the ERC and business scope.

Establish Compliance

• Establish compliance standards based on Internal policies and guidelines / Implementing procedures (CoE, Speak-Up, Anti-Bribery [AB] and *P3’s) and on applicable local laws and regulations including Industry Code. Align local standards with global minimal standards and ensure that in all cases the most stringent law is applied.
• Establish processes and SOPs for relevant procedures.

Embed Compliance
• Establish an annual local Training Plan for Conflict of Interest, Speak-UP, AB, P3 (and ensure on-boarding and annual refreshers on compliance standards and business practices are conducted)
• Regularly monitor the completion of (e)-training courses and (e)-certification and take appropriate action to ensure the agreed completion target for (e)-training (95°/o) and (e)¬ certification of CoC (100°/o) are met. Ensure system for documenting and evidencing training completion is followed.
• Champion speak-up, transparency and a culture of integrity throughout the organization
• Foster good business collaborating relationships.
• Support the Country Head in the Identification and realization of cross-divisional synergies

Enforce Compliance

• Assess risks. Inform country leadership and Country Head on identified compliance risks. Align compliance risk mitigation plan with ERC Function Head and Country Head.
• Involvement in a process to conduct Third-Party due diligence together with relevant functions
• Inform Country Head of areas which represent a material compliance or reputational risk
• If possible and as requested, support or conduct Investigations of alleged misconduct based on allocation of responsibility by the Speak-UP.

Key Competencies:
Control & Risk Management: a business control expert with a clear objective to eliminate and/or significantly mitigate business and associated financial risks across the organization.

Ability to coordinate own compliance work with internal & external auditors and other internal compliance functions.

Experience
Audit or Business administration experience.
Business control and project management experience acquired through leading or participating in:
* SOX and/or Financial Control implementation projects
* systems and/or business process implementation projects
Implementation and control of company Policies.
Proficiency in MS Office Suite
Proficiency in SAP
Advanced Microsoft Excel Skills (a must)
